By purchasing, activating, or using services provided by Pro Radio Streaming (“Pro Radio Streaming,” “we,” “us,” or “our”), you (“Customer,” “you,” or “your”) agree to the following Service Agreement.
Pro Radio Streaming provides internet radio streaming and related services to radio stations, broadcasters, organizations, and other customers.
Depending on the plan you select, your service may include streaming server access, listener capacity, bandwidth, stream URLs, web players, album artwork and now-playing information, recently played tracks, listener statistics, AutoDJ or audio storage, SSL-compatible streaming, and technical support.
The specific features, limits, and pricing of your service are determined by the plan displayed at the time of purchase.
Your account is subject to the limits of the plan you purchase, which may include limits on simultaneous listeners, storage, bandwidth, bitrate, data transfer, or other resources.
You agree not to intentionally circumvent these limits or use your account in a way that negatively affects our platform or other customers.
If your station outgrows its current plan, we may contact you about upgrading your service.
You are responsible for providing the equipment, software, automation system, encoder, and internet connection necessary to send your station's audio to our platform unless those services are specifically included with your plan.
We will provide the connection information necessary to configure compatible streaming software.
Our support team can assist with Pro Radio Streaming settings and services, but we cannot guarantee compatibility with every third-party automation system, encoder, application, device, or internet provider.
We work to keep Pro Radio Streaming reliable and available, but no internet-based streaming service can guarantee uninterrupted operation.
Service may occasionally be interrupted because of maintenance, network problems, data center issues, internet routing problems, equipment failures, security incidents, third-party outages, or circumstances beyond our reasonable control.
Unless your plan specifically includes a written Service Level Agreement (SLA), Pro Radio Streaming does not guarantee 100% uptime.
You remain responsible for everything transmitted through your station.
This includes music, programming, commercials, sponsorships, syndicated programs, podcasts, recorded content, images, metadata, and other material you provide or distribute through our services.
You must have the legal right to broadcast or distribute the content you transmit.
You may not use Pro Radio Streaming to distribute unlawful content, infringe intellectual property rights, intentionally distribute malicious material, interfere with our network, or engage in activity that could harm our services or other customers.
We reserve the right to suspend service when reasonably necessary to protect our network, comply with legal requirements, or address serious violations of this Agreement.
Pro Radio Streaming does not provide music licensing or pay music performance royalties on your behalf unless your specific service plan expressly states otherwise.
You are responsible for determining which licenses, royalties, permissions, and reporting requirements apply to your station and programming.
These requirements may vary depending on the music you play, where your station operates, where your listeners are located, and how your programming is distributed.
Purchasing streaming service from Pro Radio Streaming does not, by itself, give you permission to broadcast copyrighted music or other protected content.
Keep your account password, streaming credentials, API credentials, and other login information secure.
You are responsible for activity occurring through your account or streaming credentials.
If you believe your account has been compromised, contact us promptly. We may reset credentials or temporarily restrict access when necessary to protect your station or our network.
Pro Radio Streaming provides reasonable technical support for our streaming platform.
We can generally assist with account access, stream connection information, server settings, stream URLs, web players, metadata, and problems directly related to our platform.
Support for third-party automation systems, studio equipment, computers, networks, websites, encoders, or other products may be limited.
Streaming services are billed according to the price and billing frequency displayed when you subscribe.
Unless otherwise stated, recurring plans are billed in advance and automatically renew until canceled.
By purchasing a recurring plan, you authorize Pro Radio Streaming and its payment processor to charge your selected payment method for recurring subscription fees and applicable taxes.
You are responsible for maintaining a valid payment method.
If we cannot process your payment, we may attempt to notify you using the contact information associated with your account.
Accounts with an unpaid balance may be suspended or terminated.
Any applicable reconnection or restoration fees will be disclosed before they are charged.
You may cancel your recurring service before your next billing date.
Your service will normally remain active through the end of the billing period you have already paid for and will then terminate.
Unless otherwise stated or required by law, payments already made are non-refundable and we do not provide prorated refunds for unused portions of a billing period.
We may change our pricing from time to time.
If a pricing change affects your existing recurring subscription, we will provide reasonable notice before the new price takes effect.
Continuing your subscription after the effective date of the new pricing constitutes acceptance of the updated price, subject to applicable law.
We may suspend or terminate an account for nonpayment, unlawful use, significant security threats, network abuse, copyright infringement, material violations of this Agreement, or activity that substantially interferes with our services.
When reasonably possible, we will provide an opportunity to correct a violation before terminating an account.
Serious security, legal, or network threats may require immediate suspension.
You should maintain your own copies of important audio, playlists, graphics, programming, and other station files.
When your service ends, information stored within your Pro Radio Streaming account may eventually be permanently deleted.
Unless your plan specifically includes backup or archival services, Pro Radio Streaming should not be considered your permanent backup or archival system.
You retain ownership of the station content, audio, logos, graphics, and other intellectual property you provide to us.
Pro Radio Streaming retains ownership of its platform, software, systems, designs, technology, documentation, branding, and other proprietary materials.
Your subscription gives you the right to use the applicable Pro Radio Streaming services while your account remains active and in good standing.
Our platform may rely on data centers, networks, software providers, content delivery networks, APIs, metadata services, and other third-party technologies.
We are not responsible for interruptions caused solely by third-party systems outside our reasonable control, although we will make reasonable efforts to restore affected services.
To the maximum extent permitted by law, Pro Radio Streaming will not be responsible for indirect, incidental, special, consequential, exemplary, or punitive damages resulting from your use of or inability to use our services.
This includes lost advertising or sponsorship revenue, lost listeners, lost profits, lost data, or lost business opportunities.
To the maximum extent permitted by law, our total liability relating to the service will not exceed the amount you paid Pro Radio Streaming for the affected service during the three months immediately preceding the event giving rise to the claim.
Nothing in this section limits liability that cannot legally be limited.
You agree to indemnify and hold Pro Radio Streaming and its owners, employees, contractors, and affiliates harmless from third-party claims resulting from content you transmit, your violation of intellectual property rights, your failure to obtain required licenses or permissions, unlawful use of the service, or your material violation of this Agreement.
We may update, improve, replace, or modify features of Pro Radio Streaming as our technology evolves.
We may also make changes when necessary for security, reliability, legal compliance, compatibility, or performance.
When practical, we will provide reasonable notice of changes that materially reduce the primary functionality of a paid service.
We may update this Service Agreement periodically.
When changes materially affect your rights or obligations, we will provide reasonable notice when required by applicable law.
Your continued use of Pro Radio Streaming after updated terms become effective constitutes acceptance of those terms, subject to applicable law.

By creating an account, purchasing a service, or checking the acceptance box during checkout, you acknowledge that you have read and agree to the Pro Radio Streaming Service Agreement.

Customers should not publicly post streaming administration passwords, account credentials, API keys, or other private access information.
If you believe credentials have been compromised, you should notify Pro Radio Streaming promptly so appropriate security measures can be taken.
Pro Radio Streaming uses reasonable administrative, technical, and organizational safeguards designed to protect information under our control.
However, no website, internet transmission, cloud service, or electronic storage system can be guaranteed to be completely secure.
Customers are responsible for maintaining appropriate security for their own devices, computers, networks, automation systems, passwords, and authorized account users.
If we become aware of a security incident affecting personal information for which notification is required by applicable law, we will take reasonable steps to investigate, contain, and address the incident.
We will provide legally required notifications in accordance with applicable law.
We may disclose information when reasonably necessary to:
Comply with applicable law or legal process
Respond to a valid subpoena, court order, or governmental request
Protect the rights or property of Pro Radio Streaming
Protect customers, users, or members of the public

Confidentiality obligations do not apply to information that:
Was publicly available when disclosed;
Becomes publicly available without a violation of this Agreement;
Was lawfully known to the receiving party before disclosure;
Is lawfully obtained from another source without a confidentiality obligation;
Is independently developed without using confidential information; or
Must be disclosed pursuant to applicable law or valid legal process.
If either party becomes aware of unauthorized access to or disclosure of confidential information belonging to the other party, that party should provide prompt notice when reasonably practical.
The parties agree to reasonably cooperate in addressing a legitimate confidentiality or security concern.
Disclosure of confidential information does not transfer ownership of that information or grant intellectual property rights except for the limited rights necessary to use Pro Radio Streaming services.
Each party retains ownership of its respective intellectual property and confidential information.
Our website or platform may contain links to or integrations with third-party websites, applications, services, or platforms.
Those third parties may maintain their own privacy policies and terms. Pro Radio Streaming is not responsible for the privacy practices of independent third-party services.
You should review the privacy terms of third-party services you choose to use.
Information may be processed or stored in locations different from where a customer or listener is located.
Where applicable law requires specific safeguards for international transfers of personal information, we will use appropriate measures as required for information under our control.
We may update this Personal Data & General Confidentiality Agreement as our services, technology, or legal requirements change.
The current version will be made available through the Pro Radio Streaming website.
When required by applicable law, we will provide additional notice of material changes.
This Agreement should be read together with the Pro Radio Streaming Service Agreement and any other policies or terms applicable to the service you purchase.
If specific data-processing terms are required for a particular customer or service, those terms may be addressed through a separate Data Processing Agreement or written addendum.
Questions, privacy requests, confidentiality concerns, or reports of suspected unauthorized access may be submitted through the contact or support options provided on the Pro Radio Streaming website.
